Terms of Use
These terms are an agreement between you and [OPERATOR] ("Yaya", "we", "us") about your use of Yaya at yayaya.app. By using Yaya you agree to them and to our Privacy policy. If you don't agree, please don't use Yaya.
Section 12 says that most disputes between you and Yaya will be settled by individual arbitration, not in court, and that you give up the right to bring or join a class action. Please read it.
1. What Yaya is, and what it isn't
Yaya is an AI shopping assistant. You describe what you're looking for, and Yaya suggests products from independent brands and links you to each brand's own website to buy.
Yaya doesn't sell anything. We are not the seller of any product you see here, and we are not a party to any purchase you make. When you follow a link to a brand's site, your order, payment, delivery, shipping, returns, refunds, exchanges and warranties are all between you and that brand, on that brand's terms. Yaya never takes your payment and can't cancel, change or refund an order. If something goes wrong with an order, contact the brand.
2. Who can use Yaya
Yaya is currently a preview for shoppers in the United States. You must be at least 18, or the age of majority where you live, to use it. We may change, pause or stop any part of Yaya, or limit who can use it, at any time.
3. Recommendations, AI and accuracy
Yaya uses automated systems, including AI models, to read brands' product data and match it to what you ask for. That has limits you should know about:
- Product details — prices, stock, sizes, colors, materials (for example "100% cotton"), fit, origin and other claims — come from brands' own data and from our automated processing of it. Either can be wrong, incomplete or out of date.
- Yaya tries to show only items with evidence that they match your request and to say when a detail isn't stated, but it can still misread a request or a product.
- Where we can't confirm a brand's current shipping or returns policy, Yaya flags it. A flag, or the absence of one, is not a guarantee of any brand's terms.
Before you buy, check the price, availability, materials, sizing and policies on the brand's own site. What the brand's site says is what applies to your purchase. Yaya's suggestions are general shopping help, not professional advice of any kind.
4. Commission
Yaya may earn a commission when you buy from a brand you found here, through that brand's affiliate program. It never affects what you're shown: results are ranked only on how well they fit what you asked for, and no brand can pay to appear. Links to brands may carry an affiliate tracking code so the brand knows you came from Yaya.
5. Using Yaya fairly
Yaya is for people shopping for themselves or someone they know. You agree not to:
- scrape, crawl or copy Yaya's results or data, or use bots, scripts or other automated means to send searches or otherwise access Yaya, unless we've agreed in writing;
- get around, disable or interfere with our rate limits, daily search limits, bot checks (such as Cloudflare Turnstile), invite gate or other security measures — for example by rotating browsers, cookies or IP addresses;
- use Yaya to build or train a competing product or dataset;
- overload, probe or attack Yaya, or try to get at parts of it you weren't given;
- use Yaya for anything unlawful, or to submit content that is unlawful, abusive or infringes someone else's rights; or
- misrepresent who you are, or sell or share invite codes.
We may limit, suspend or block access for anyone we believe is breaking these rules, without notice.
6. What you type
You keep whatever rights you have in what you type into Yaya. You let us use it to run Yaya, to improve it, and to produce aggregate insight as described in the Privacy policy. Please don't enter sensitive personal information, such as payment details or health information, in your searches.
7. Other sites and trademarks
Yaya links to brands' websites and other sites we don't control. We aren't responsible for their content, products, policies or practices, and their own terms and privacy policies apply when you use them.
Brand names, logos, product names and product images belong to their owners. Showing a brand or product on Yaya doesn't mean that brand endorses Yaya, or that Yaya endorses the brand, unless we say so.
8. Yaya's own content
Yaya's software, design, text and name belong to us or our licensors. We give you a personal, non-transferable permission to use Yaya under these terms, and nothing more.
9. No warranties
Yaya is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy. We don't promise that Yaya will be uninterrupted, error-free or secure, that any result is accurate, complete or current, or that any product will be available, priced as shown or as described. We make no warranty about any product sold by a brand.
10. Limits on our liability
To the fullest extent the law allows, Yaya and its operators will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data or goodwill, arising out of or related to Yaya or these terms, even if we were told they were possible. We are not liable for any product, order, payment, delivery, return or other dealing between you and a brand. Our total liability for all claims arising out of or related to Yaya or these terms is limited to fifty U.S. dollars ($50).
Some places don't allow some of these exclusions or limits, so they may not all apply to you. Nothing in these terms limits liability that can't be limited by law.
11. Indemnity
If someone brings a claim against us because you broke these terms or the law while using Yaya, you agree to cover our reasonable losses and costs from that claim, including reasonable attorneys' fees. We'll tell you about the claim and may choose to control the defense.
12. Disputes, arbitration and class-action waiver
Talk to us first. If you have a problem with Yaya, write to [email protected]. Most issues can be sorted out quickly. If we can't resolve it within 60 days, either of us may start a formal proceeding as described below.
Arbitration. You and Yaya agree that any dispute arising out of or related to Yaya or these terms will be resolved by final, binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitrator decides all questions, including whether a dispute must be arbitrated, except as stated in this section. The Federal Arbitration Act governs this section.
Small claims. Either of us may instead bring an individual claim in small claims court, as long as it stays there and is only on an individual basis.
No class actions. You and Yaya each give up the right to a jury trial and to bring or take part in any class, collective or representative action. Claims may be brought only individually. If this waiver is found unenforceable for a particular claim, that claim must be heard in court, not in arbitration, and the rest of this section still applies.
Opting out. You can opt out of arbitration within 30 days of first using Yaya by emailing [email protected] with your name and a statement that you opt out. Opting out doesn't affect the rest of these terms.
13. Governing law
These terms are governed by the laws of the State of [STATE] and applicable U.S. federal law, without regard to conflict-of-law rules. Any claim not subject to arbitration will be heard in the state or federal courts located in [STATE], and you and Yaya consent to their jurisdiction, except where the law gives you the right to bring a claim where you live.
14. Changes to these terms
We may update these terms as Yaya changes. We'll post the new version here and update the date at the top; if a change is significant, we'll make reasonable efforts to let you know on Yaya. Changes apply from the time they're posted and don't apply to a dispute we already knew about. If you keep using Yaya after a change, you accept the updated terms.
15. The rest
If any part of these terms can't be enforced, the rest still applies. If we don't enforce a term right away, we haven't given it up. You can't transfer these terms to anyone else; we may transfer them to whoever takes over Yaya. These terms and the Privacy policy are the whole agreement between you and Yaya about using it.
